Private Military and Security Companies (P.M.S.C.s) have played an increasingly prominent role in conflicts over the past 40 years. Following the fall of the Soviet Union, many major powers substantially decreased their military budgets. This decrease led to a surplus of ex-military personnel seeking employment and a surplus of military hardware that private firms could purchase. Next Monday’s argument in Hencely v Fluor Corporation asks the justices to consider the extent to which military contractors can be held liable in tort suits – that is, a lawsuit seeking damages for harm caused by someone else’s wrongful actions or negligence – brought under state law.
